Under RCW 39.10.420, all public bodies in the state of Washington are authorized to award job order contracts and use the job order contracting procedure.

A JOC is a contract in which the contractor agrees to a fixed period, indefinite quantity delivery order contract which provides for the use of work orders not to exceed $500,000 pre-tax, where at least 90% of the work must be subcontracted. The intended use for JOC contracts is for small, time sensitive construction projects with limited or no design. Architectural and engineering services shall be procured in accordance with RCW 39.80.040.

Facility Professional Services (FPS) is currently under contract with six (6) JOC contracts. Two (2) statewide and four (4) regional, each with a capacity of $6 million per contract year. The FPS Project Managers are the responsible party authorized to initiate individual work orders and administrate the JOC on behalf of their client agencies.

PWSBE certification

Starting July 1, 2026, DES will use the Public Works Small Business Enterprise (PWSBE) certification to track small business participation on public works projects. Businesses can still bid without certification, but only PWSBE-certified businesses will be counted toward participation goals.
